Terms of Service

These terms cover everything you buy from Dominguez Web Builders: website plans, design work, and advertising plans. Dominguez Web Builders is owned and operated by Hector Luis Dominguez in Mission, Texas ("DWB", "we", "us"). "You" means the business or person buying from us.

You agree to these terms when you check the terms box at checkout, pay one of our payment links or invoices, or sign a service agreement with us. If you sign a separate written agreement with us, that agreement controls wherever it differs from this page.

01What is included

We design, build, host, and maintain a professional website for your business based on the plan you choose. That includes design and development, hosting, help with your domain, content updates as described in your plan, and ongoing technical maintenance. Work outside your plan is quoted and billed separately, only with your approval first.

02Plans and pricing

The setup fee is paid before we start building and includes your first month of service. Your monthly subscription begins 30 days after checkout. The setup fee is non refundable once work has begun. The monthly fee covers hosting, maintenance, and the plan features in effect when you enrolled.

03Content updates

Content updates are included in your monthly plan. Send them by text or email any time. We usually finish them within two business days. If you have several changes, send them together so we can do them in one pass.

Included updates cover routine changes: text edits, photo swaps, hours, contact information, and adding or removing services on existing pages. A brand new page, a full redesign, or new custom features are outside the plan. We will quote that work first and never bill it without your approval.

04Your preview and launch

You see a preview of your website before it goes live, and one round of revision requests is included before launch. You provide the content we need: business name, logo, service descriptions, photos, hours, and contact information. We are not responsible for delays caused by content that arrives late.

05Billing and late payment

Your monthly fee is charged automatically to the card you saved at checkout. If a payment is more than 7 days past due, we may suspend your website until it is paid. Accounts more than 30 days past due may be terminated under Section 07.

06Who owns the website

DWB keeps all rights to the design, code, and structure of the website until you either buy it out under Section 07 or we both sign a written ownership transfer. Content you give us, such as your logo, photos, and written information, always stays yours.

07Cancellation and buyout

Either side may cancel at any time with written notice. Email or text is fine. When you cancel, you choose one of two options:

Option A: buy the website. The buyout price is twelve months of your current monthly rate. Once it is paid in full, we transfer all website files within 7 business days. You must choose the buyout within 14 days of your cancellation notice.

Early buyout: the standard buyout price applies once you have paid for at least six months. If you buy out earlier, you pay the standard buyout plus the monthly payments still needed to reach six paid months. Example on Premium: in month 3 you have paid 3 months, so you owe the $2,388 buyout plus 3 catch up months ($597), for $2,985 total. In month 6 or later you owe only $2,388.

Option B: take the website down. Your site stays live through the end of the month you already paid for. After that it goes offline and we keep the files.

08Hosting and uptime

We make reasonable efforts to keep your website online and fast. We do not guarantee 100% uptime and are not responsible for downtime caused by our hosting provider, server maintenance, cyber attacks, or other events outside our control.

09Pricing and quotes

Design prices are listed on our Design Services page. A full vehicle wrap layout starts at a $600 base price, and the final price is quoted after we see the vehicle. Edits to files made by others are billed at $75 per hour. Any quote we give you is valid for 90 days.

10Payment

You can pay in full at checkout on our website, or ask us for a 50% deposit invoice. Work starts once your payment or deposit clears. With a deposit, the balance is due before we release your final files.

11Revisions

Every design item includes two rounds of changes, or more if the item's listing says so. Extra rounds are $35 each. A change of direction after you approve a concept counts as a new job, and we will quote it before starting.

12Timeline and rush

Simple items usually take 2 to 3 business days. Logos and larger pieces take about a week. The clock starts once we have your materials and your payment. Rush delivery in 48 hours is available for 50% extra on any item.

13Your files and who owns the design

Once you have paid in full, you own the final design you approved and receive print ready files you can take to any printer. Concepts you did not choose remain ours. Fonts, stock photos, and similar assets are licensed under their own terms, and we will tell you if any need a separate license for your use. We may show finished work in our portfolio and on social media unless you ask us in writing not to.

14Printing

Printing and shipping are not included: we design, your printer prints. You approve the final proof before we release files, so please check spelling, phone numbers, and details carefully. We are not responsible for printing costs, printer errors, or color differences between screen and print.

15Design refunds

If you cancel before we start work, we refund your payment in full. Once we have delivered first concepts, payment for that item is non refundable. If we are unable to deliver an item you paid for, we refund that item in full.

16Plans

Advertising plans are available to any business with a live website, whether we built it or not.

17Billing, changes, and cancellation

Advertising plans have no setup fee. They are billed monthly in advance to the card you saved at checkout, and they are month to month with no contract. Cancel any time by text or email. Cancelling stops your next renewal. Service continues through the end of the month you already paid for, and that month is not refunded. You can move up or down a level any time, and the change takes effect on your next billing date.

18Ad budget on Full Reach

On Full Reach, the money spent on ads is paid directly to Meta (Facebook and Instagram) using your own payment method, and you decide how much to spend. We suggest starting around $150 to $200 a month. Our monthly fee never comes out of your ad budget. Ad charges are between you and Meta, and we are not responsible for them.

19Access to your accounts

To do the work, you give us manager or partner access to your Google Business Profile, Facebook page, Instagram account, and Meta ad account as needed. These accounts always belong to you. Where a platform offers partner access, we use that instead of asking for your password. When you cancel, we remove our access or you may remove it yourself.

20Content and posting

We build posts and ads from the photos and information you provide, and we post on your behalf as your plan describes. You confirm you have the right to use everything you send us. You may review content before it goes out if you ask. We follow each platform's rules and may decline to post anything that breaks the law or a platform policy.

21No guaranteed results

We work hard to get you found and in front of new customers, but we cannot guarantee search rankings, reviews, leads, calls, or sales. Google and Meta control their own algorithms, ad approvals, and account decisions. We are not responsible for platform outages, policy changes, ad rejections, or account restrictions they impose.

22Payments

Payments are processed by Stripe. We never see or store your full card number. When you start a monthly plan, you authorize us to charge the card you saved for each billing period until you cancel. Prices do not include sales tax, which is added at checkout where it applies. If a charge fails, we will contact you, and service may pause until it is paid.

23Refunds at a glance

• Website setup fee: non refundable once work has begun.
• Monthly fees for websites and advertising: charged in advance, not prorated, and not refunded for partial months.
• Design work: see Section 15.
• Disputes: if something is wrong with a charge, contact us first and we will make it right. A chargeback on work already delivered may lead to suspension of your services.

24Your content and responsibilities

You are responsible for making sure the content you give us, including logos, photos, text, and claims about your business, does not infringe anyone else's rights or break any law. You agree to cover any legal claims that arise from content you supplied.

25Privacy

We keep your business information private and use it only to provide your service. Our Privacy Policy explains what we collect and how we use it.

26Limitation of liability

We are not liable for indirect, incidental, or consequential damages arising from our services or from the use or inability to use your website, accounts, or ads. Our total liability for any claim will not exceed the total you paid us in the three months before the claim.

27When we may end service

We may end service for nonpayment as described above, for abusive conduct toward us, or if you ask us to publish illegal content. If we end service for any other reason, we will refund any prepaid time you have not used.

28Changes to these terms

We may update these terms. Active clients will be emailed at least 14 days before a material change takes effect, and the current version is always on this page. Continuing to use our services after the effective date means you accept the updated terms.

29Governing law

These terms are governed by the laws of the State of Texas. Any dispute will be resolved in the appropriate courts of Hidalgo County, Texas.

30Entire agreement and contact

These terms, together with any written agreement you sign with us, are the entire agreement between you and DWB for the services described, and replace any earlier discussions. Questions? Call or text Hector at (956) 207-7751 or email .
